The administration of Donald Trump has issued a presidential memorandum citing the Defense Production Act of 1950 to increase oil production and lower energy prices. This memorandum was issued on Thursday and declares oil production and processing as vital activities for national defense. This decision was made following Trump's declaration of a national energy emergency in January 2025.

Importance of Domestic Oil Production

In this memorandum, Trump emphasized that "ensuring the capacity for oil production, processing, and logistics within the country is essential for the defense readiness of the United States." He warned that "without immediate federal action, the United States' defense capabilities will be vulnerable to disruptions." This memorandum comes as gasoline and diesel prices are sharply rising, a surge attributed to supply disruptions due to the U.S. and Israel's war against Iran.

Economic and Political Implications

Following this decision, Brent crude oil prices reached $114.47 per barrel, and high energy prices and related inflation are expected to become key issues for voters in the upcoming midterm elections. The President's memorandum essentially indicates that energy production shortages are considered a threat to national defense.

This memorandum references Section 303 of the Defense Production Act, allowing the federal government to intervene in the private sector. This section enables the President to make purchases, provide financial support and equipment, and expand production through other measures. Additionally, this memorandum has removed certain requirements through an emergency exemption.

While this memorandum did not specify which projects could be funded, J.D. Vance, the Vice President, stated last week that the administration would use the Defense Production Act to increase capacity at a refinery owned by Delek US in Texas.

Trump warned in this memorandum that without action, the U.S. industry would not be able to provide sufficient energy services in a "timely manner." This weakness has arisen due to funding constraints, long timelines for obtaining permits, and infrastructure issues.

This law, enacted during the Korean War, was first utilized to expand domestic industries in critical materials like aluminum and titanium for national defense. It was also used during the pandemic to finance domestic production of pharmaceuticals and vaccines. Former President Joe Biden also used this law to support the production of clean energy and related supply chains.

The Trump administration is seeking to use this law to take actions to reduce energy prices following the war with Iran. For instance, earlier this month, Trump signed an executive order to temporarily expand access to tax-free diesel. Additionally, the G7 countries, including the United States, agreed to release 100 million barrels from reserves of diesel and crude oil to the market over four months.

Despite criticisms from environmental activists regarding Trump's use of Section 303 of this law for fossil fuel projects, this law clearly includes energy production and construction in its definition of national defense. Analysts and industry stakeholders believe that any reduction in energy prices is likely to be limited and short-term.
